(3) In these general terms and conditions, LUXIMMO Ltd. will be referred to as "LUXIMMO FINEST ESTATES," "Agency," or "Company" for brevity.

The website https://gravity.lxm.bg/ offers a catalog of real estate for sale or rent with the corresponding prices listed. The listings are prepared based on data provided by sellers, landlords, builders, investors, agencies, and other parties in partnership and cooperation with LUXIMMO FINEST ESTATES. Article 19. The Company is required to formalize all relationships related to the provided services through a separate written agreement, according to the type of service provided and the individual arrangements with each counterparty. By signing such an agreement, each user commits to LUXIMMO FINEST ESTATES for the execution of a transaction involving the purchase, sale, or leasing of real estate.

Assignment of Orders and Contract Conclusion

Article 20. To use the intermediary services offered by LUXIMMO FINEST ESTATES and to access the available real estate database, Users utilize the website https://gravity.lxm.bg/. Article 21. A separate contract must be concluded between the User, acting as the client, and the Agency, acting as the service provider, for the assignment and execution of each service provided by LUXIMMO FINEST ESTATES. The contract takes effect from the moment it is signed, and the agreed terms are binding on the parties for the duration of the contract. Article 22. All contracts, agreements, and annexes to contracts and agreements, as well as all protocols, receipts, and declarations are drafted in accordance with the legal requirements of the legislation, reflecting the parties` intentions, including the customary practice requirements. They comply with the internal organization, activities, and documents of the Agency, ensuring complete confidentiality of the provided data and adherence to the data protection policy implemented by LUXIMMO FINEST ESTATES.

Prices of Offered Properties

Article 23. (1) The prices of properties offered on this website are those indicated by sellers, landlords, real estate developers, investors, agencies, and other parties in contractual relations with the Agency. Article 23. (2) The prices of the offered properties are listed in euros. As a rule, the prices include value-added tax (VAT), unless explicitly stated otherwise in the offer. If the price does not include VAT, this should be explicitly stated in the offer. Article 23. (3) The Agency has the right to change the prices listed on the website for the offered properties. Such changes will not affect contracts that have already been concluded, unless the specific contract stipulates that any change in the price proportionally adjusts the commission fee payable by the User to LUXIMMO FINEST ESTATES.

Anti-Money Laundering Measures

Article 24. The Company has established Internal Rules for controlling and preventing money laundering and terrorist financing, in its capacity as an obligated entity under Article 3, Paragraph 2, Item 29 of the Anti-Money Laundering Act (AML Act). Article 25. (1) When establishing contractual relations for the Agency to perform the services it provides, the Agency is required to identify each User involved in the transaction in accordance with the AML Act. The User must complete and sign a declaration under Article 4, Paragraph 7 and Article 6, Paragraph 5, Item 3 of the AML Act, using a form approved by the Internal Rules mentioned in the previous paragraph of this Article. It is mandatory for the User to complete a declaration regarding the origin of the funds when establishing commercial or professional relationships, including when opening an account, as well as when performing a transaction or entering into an agreement worth over BGN 30,000 or its equivalent in foreign currency, and when performing a transaction or entering into an agreement in cash worth over BGN 10,000 or its equivalent in foreign currency. Article 25. (2) A declaration regarding the origin of the funds must also be completed in cases where multiple transactions or agreements, each individually not exceeding BGN 30,000 or its equivalent in foreign currency, or BGN 10,000 or its equivalent in foreign currency in cash, respectively, are conducted, but there is evidence that the transactions or agreements are related.

Unsolicited Electronic Communications

Article 26. Commercial communications, as defined by the Electronic Commerce Act, are advertising or other messages presenting the services of a person engaged in commercial or craft activities, or exercising a regulated profession. As a company engaged in commercial activities, LUXIMMO FINEST ESTATES has the legal right to send unsolicited commercial communications to Users of the website https://gravity.lxm.bg/, including offers, advertisements, newsletters, and inquiries. By accepting the terms and conditions posted on this site, Users consent to receive unsolicited commercial communications from the Agency. Article 27. Any User may send a written request via email to LUXIMMO FINEST ESTATES to opt out of receiving unsolicited commercial communications, and will be removed from the list of recipients. The User should also inform the Agency if they do not wish their data to be used for direct marketing purposes.

Intellectual Property

Article 28. (1) The intellectual property rights over the databases available on the Agency`s website are protected by the Copyright and Related Rights Act and may not be used in violation of applicable legislation. If the website contains intellectual property owned by another party that has granted LUXIMMO FINEST ESTATES the right to use it, that party must be explicitly acknowledged as the holder of the specific intellectual property rights. (5) Unless explicitly agreed otherwise, Users do not have the right to reproduce, modify, delete, publish, distribute, or otherwise disseminate the information resources published on the LUXIMMO FINEST ESTATES website. Article 29. LUXIMMO FINEST ESTATES has the right to deactivate or delete a User`s account if the User violates the intellectual property rights concerning the elements of the website that are subject to intellectual property protection.

Liability

Art. 30. Art. 30. (2) If necessary, the measures for the protection of personal data are reviewed and updated by LUXIMMO FINEST ESTATES. Art. 31. (1) The Company is not liable for technical malfunctions whose causes do not fall within the Company`s responsibility or are caused by force majeure circumstances. (2) LUXIMMO FINEST ESTATES is not liable if viruses or other harmful components are found on the site server. Art. 32. Art. 32. (2) The Company does not owe compensation for damages to Users of the website for errors or defects in the use of the site, computer viruses, or theft resulting from the use of the site or links to other sites through the website. Art. 32. (3) In case of systematic violations of the website`s terms of use by a User who has accepted them, the Agency has the right to prohibit access to its website from the mobile device, email, and IP address of the violator. Art. 32. (4) LUXIMMO FINEST ESTATES is not liable for offensive or illegal behavior of other site users or third parties. Art. 32. (5) Users of the website https://gravity.lxm.bg/ are obliged, while using the Agency`s site, to protect its employees and directors from assaults and damages and to prevent such occurrences.

Additional Terms

Art. 33 The Company has the right to unilaterally amend the general terms of use of its website at any time and at its discretion due to legislative changes; the introduction of new rules deemed necessary by the Agencys practice; or the need to improve the quality of services provided by the Agency. All changes will be posted on the official website page and will take effect from the day of their publication there. From that moment, it is also considered that all Users are informed of the changes made. It is the Users responsibility to periodically check the general terms for updates. Art. 34 All issues not regulated by the general terms will be governed by the current legislation of the Republic of Bulgaria. The competent court for any disputes is the Bulgarian court. In the event that certain clauses of these general terms related to the contracts or appendices to them, governing the relationship between Users and the Agency, are or become null and void, this does not affect the validity of the remaining parts of the contract or the contract as a whole. Invalid clauses will be replaced by both parties with other valid clauses that correspond to the meaning and purpose of the contractual provisions. If agreement on their content cannot be reached, legal provisions regulating similar relationships will apply by analogy.
